TERMS AND CONDITIONS OF USE OF HEARIT

These Terms and Conditions (“Terms”) govern your use of the hearIT interactive voice response services (“the hearIT Services”) provided by Zinga Tech (Pty) Ltd, registration number 2019/133459/07 (“Zinga”). By subscribing to or otherwise accessing any hearIT Service, you agree to be bound by these Terms.

Important: Your attention is specifically drawn to clauses 6 and 7 that limit the risk and liability of, and impose an obligation on you to indemnify, Zinga and other parties.

1. Services

  1. Each hearIT Service is a mobile airtime subscription billed at a specified daily rate (e.g., R5.00/day) (“Daily Subscription Fees”) depending on the hearIT Service, governed by these Terms and the service-specific terms published at www.hearit.co.za . The first day following the day on which you subscribe will be free.
  2. Subscription grants you access to specific content or features, which may include entertainment, information, or other digital services, for as long as you remain subscribed.

2. Use of the hearIT Services

You may not use a hearIT Service if you:

  • lack the legal capacity to enter into a binding contract;
  • are not permitted to access or use the service under applicable laws;
  • require parental or guardian consent and have not obtained it; or
  • do not meet the minimum age requirement for the service.

Certain hearIT Services may require age verification. You undertake to only provide confirmation and use such services if you meet the applicable requirements.

You warrant that you will not:

  • transmit unlawful, obscene, threatening, racist, defamatory, or otherwise objectionable material;
  • use the services for spam, junk mail, chain letters, or mass distribution;
  • copy, store, mirror, cache, adapt, modify, or reuse service content beyond personal, non-commercial use without written permission.

3. Cancellation

  1. You may cancel your subscription at any time by following the instructions provided in welcome and reminder messages.
  2. Cancellation stops future billing but does not refund past charges.

4. Billing and Payment

  1. Daily Subscription Fees are charged to your mobile account via your network provider.
  2. You authorise Smartcall Technology Solutions (Pty) Ltd (“STS”) to recover fees on behalf of Zinga.
  3. Network data charges may apply in addition to subscription fees.
  4. Errors will be billed.

5. Marketing Communications

  1. By subscribing, you consent to receive marketing messages from Zinga, STS, and partners.
  2. You may opt out at any time via the instructions provided or by contacting support.

6. Disclaimer

  1. hearIT Services are provided “as is” without warranties of any kind, including merchantability, fitness for purpose, or accuracy.
  2. Zinga does not warrant uninterrupted, error-free, or secure service delivery and accepts no liability for inaccuracies or errors.
  3. Predictive content (e.g. horoscopes, fortune-telling) is provided for entertainment only and should not be relied upon. Any decisions made are at your own risk.

7. Indemnification

  1. You indemnify Zinga against all losses arising from your breach of these Terms or use of the Services, except where caused by gross negligence or misconduct.
  2. Zinga is not liable for failures caused by events beyond its reasonable control.

8. Suspension and Termination

  • breach of these Terms;
  • non-payment of subscription fees;
  • legal or regulatory requirements; or
  • service discontinuation.

9. General

Applicable Law: These Terms are governed by South African law and disputes shall be determined by South African courts.

Changes: Zinga may amend these Terms at any time by publication on its website.

Waiver: No indulgence or delay shall constitute a waiver of any rights.
